1. General Provisions

This document establishes the terms and conditions for the use of the rewal.cards platform ("the Platform"). Accessing or using the Platform constitutes full and unconditional acceptance of these Terms and Conditions ("the Terms").

If you do not agree with the Terms, you must discontinue use of the Platform immediately.

2. Definitions

For the purpose of this document:

Platform – the rewal.cards website, applications, software, services, and functionalities.

User – any individual accessing or using the Platform.

Account – the profile created by the User to access certain functionalities.

Digital Loyalty Card – a digital card generated through the Platform, containing identifiers, QR codes, or other information relevant to loyalty-based features.

Content – any information, data, text, images, or other materials uploaded, provided, or generated by the User.

Services – the full set of functionalities provided by the Platform.

3. Acceptance of the Terms

By using the Platform, the User declares that:

they have read and understood the Terms;

they agree to fully comply with these Terms;

they are of legal age or have the consent of a parent/legal guardian, where applicable.

4. Description of Services

The Platform provides tools for:

creating, generating, and managing digital loyalty cards;

generating QR codes embedded in loyalty cards;

sharing cards via public links;

managing data associated with created cards;

additional functionalities that may be introduced at any time.

The Platform reserves the right to modify, suspend, or remove any functionality at any time without prior notice.

5. User Account

Creating an Account may be required to access certain features.

The User is responsible for maintaining the confidentiality of login credentials.

Any action performed through the Account is deemed to be performed by the Account holder.

The Platform may suspend or terminate Accounts in cases of abusive, fraudulent, or non-compliant conduct.

6. Permitted Use

The User agrees NOT to use the Platform to:

engage in illegal, fraudulent, or non-compliant activities;

generate or distribute cards without the consent of the individuals involved;

infringe third-party intellectual property rights;

transmit or distribute malware, spam, or malicious links;

attempt to manipulate, overload, or disrupt Platform systems;

collect or process personal data of other Users without authorization.

The Platform may remove Content or suspend access if these rules are violated.

7. Card Distribution

Digital loyalty cards created through the Platform are public, and may be accessed by anyone who possesses the link or QR code.

The User is solely responsible for sharing links or QR codes and for the information included in the card.

The Platform is not responsible for access performed by third parties through links shared by the User.

8. Data Collected

The Platform may collect the following personal data provided directly by the User:

name,

email address,

phone number.

Data may also be collected through the digital cards created and shared by the User.

9. Third-Party Services

The Platform may use the following external service providers:

Google Analytics – traffic and usage analytics;

Mailjet – email communications;

Vercel – hosting and infrastructure services;

Cloudflare – security and performance optimization;

Supabase – data storage and backend services.

Data may be processed or transferred through these third-party services in accordance with their own privacy policies.

10. Intellectual Property

All rights to the Platform (design, software, code, functionalities) are reserved.

The User retains ownership of their own Content.

By uploading Content, the User grants the Platform a non-exclusive license strictly required for providing the Services.

11. Limitation of Liability

To the maximum extent permitted by law:

The Platform is provided "as is," without guarantees of uninterrupted or error-free operation;

The Platform is not liable for data loss, unauthorized access resulting from link sharing by the User, or damages arising from the use of the Services;

The Platform is not responsible for interruptions, errors, delays, lack of availability, or inability to access the Services.

12. Termination of Use

The User may stop using the Platform at any time. The Platform may restrict or suspend access in cases of violation of the Terms or for security-related reasons.

13. Changes to the Terms

The Platform may update these Terms at any time. The updated version will be available on the website. Continued use of the Platform constitutes acceptance of the changes.

14. Governing Law

These Terms are governed by the laws of Romania.

Any disputes shall be resolved amicably, and if this is not possible, by the competent Romanian courts.
